KNAB pirmstiesas izmeklēšanā iegūtie pierādījumi liecina, ka valsts amatpersona, pārsniedzot savas dienesta pilnvaras un mantkārīgu nolūku vadīts, nelikumīgi panāca sava materiālā stāvokļa uzlabošanu. Proti, nelikumīgi pats sev izsniedza 38 aizdevumus, pašvaldības kapitālsabiedrību līdzekļus pārskaitot uz savu privāto bankas kontu. Saskaņā ar normatīvajiem aktiem šādu darbību īstenošana ir aizliegta. Noziedzīgais nodarījums īstenots laika posmā no 2022. gada 6.septembra līdz 27. novembrim.
KNAB kriminālprocesu uzsāka 2023. gada 21. februārī un izmeklēja valsts amatpersonas dienesta pilnvaru pārsniegšanu mantkārīgā nolūkā. Atbildība par šāda noziedzīga nodarījuma izdarīšanu paredzēta Krimināllikuma 317. panta otrajā daļā.
KNAB, nosūtot krimināllietas materiālus Noziedzīgu nodarījumu valsts institūciju dienestā izmeklēšanas prokuratūrai, noslēdza attiecīgo pirmstiesas izmeklēšanu. Pašlaik prokuratūrai kā procesa virzītājai jālemj par krimināllietas turpmāko virzību.
KNAB vērš uzmanību, ka jebkurā kriminālprocesā iesaistītajām personām ir tiesības uz aizstāvību, un atgādina, ka nevainīguma prezumpciju piemēro visos kriminālprocesa posmos – sākot no brīža, kad persona tiek turēta aizdomās vai apsūdzēta, līdz brīdim, kamēr tās vaina noziedzīga nodarījuma izdarīšanā tiek konstatēta likumā noteiktajā kārtībā.

Mūsu tieslietu sistēmas impotence ir apbrīnas vērta! Jebkurš acīmredzams antisociāls zaglīgs elements ir neaizskarams, kamēr tiesa nav pasludinājusi viņu par vainīgu. Pārējiem labāk pievērt acis un par to nedomāt!
